It is important that you carefully read this terms and conditions as it governs your use of Excellot.com website and mobile applications provided by Excellot LLC. The Sites are intended for individuals seeking employment and for employers or recruiters seeking candidates for employment or customers looking for training courses and the respective trainers. You may use the Sites only for lawful purposes within the stated context of Excellot intended and acceptable use of the sites. You are agreeing as user of Excellot website and mobile applicationthat by viewing and signing for jobs, posting job as an employer and other visitors using the website for one purpose or the other that you are entering into a legally binding contract with Excellot (including users using Excellot website on behalf of their company) on an acceptable use of Excellot website and mobile application. Excellot is the sole interpreter of the sites’ intended and acceptable use.
This terms and conditions govern the use of Excellot website (excellot.com) and its mobile applications and is effective from February 11, 2019.
The terms and conditions stated below can be reviewed and amended as required from time to time, and in addition to your advertising forms a binding agreement between you (job seekers), your organization (employers) and Excellot. Your continuous use and access of Excellot website and mobile applications indicates your acceptance of these Terms and Conditions.
The website (Excellot.com) and its contents are sole property of Excellot and are protected under United States of America and foreign copyrights, trademark and other laws.
As such you cannot copy or duplicate (except those granted permission by Excellot) any content on Excellot.com website including but not limited to the HTML codes, website materials and contents.
Excellot does not guarantee employment to any of its users and job seekers are using Excellot website and mobile applications with this understanding. Job application review, interview, hiring and salary decisions is at the discretion of the employer and Excellot does not in any way interfere with the employer’s decision.
Employers are granted non-exclusive and terminable right to Excellot website and as such can use the website for solely business purposes relating with job seekers for employment purposes. Employers are not allowed to sell to job seeker nor offer employments to job seekers in exchange for monetary rewards. Employers are solely responsibility for the contents or materials posted on the website and any consequence that might arise because of such posting. It is important for the Employers to know that Excellot reserves the right to suspend or terminate that privilege for any reason at any time including violation of terms and in its sole discretion know that its use of Excellot website is a privilege.
Excellot contains links to third party websites, it is important to note that the website links not an endorsement by Excellot of the contents of such websites. Excellot is not responsible and liable for the contents of the third-party websites in any way. You are accessing the third-party websites at your risk. In accessing and using Excellot website and mobile applications, it is important to note that nothing on Excellot website and mobile applications shall be considered to be a warranty, representation, or endorsement in any form with respect to the job seeker, employer, trainers, third party or other users of Excellot website and mobile applications in respect to employment, experience, training, courses, hiring, interviews or other products and services provided by Excellot LLC. Excellot website and mobile applications are provided on an “as is basis” and so do not provide warranty of any kind to its website and mobile application users. Excellot is not accountable and cannot be held liable to users in terms of timeliness, completeness, mistakes, errors or accuracy of Excellot website and mobile applications.
As a user of Excellot website and mobile application, you are responsible for your use of Excellot website and mobile application and assume risk for the use of Excellot website and mobile application including materials that are posted by you and other users as well asissues that might arise because of your relationship with other users. You are also releasing Excellot directors, employees, agents, officers, shareholders, affiliates and subsidiaries from all damages (including internet interruption, loss of data, loss of job, loss of time, loss of profit, broken internet links and other damages)that may result from your use of Excellot website and mobile application.
Job seekers accessing Excellot website and mobile application are granted rights to sign up, view and download jobs and training related material and can only do so for their personal use. Job seekers cannot in anyway sell or make profits from the downloaded materials from Excellot website and mobile applications. Violation of the terms and conditions guiding the job seekers use and access of Excellot website and mobile applications may result in disciplinary actions including suspension and termination of access. Excellot reserves the right to terminate job seeker access at any time and users of Excellot website and mobile application should know that they are accessing Excellot website and mobile application as a privilege.
Since user authentication is complex and difficult on the internet, Excellot cannot guarantee that users of its Excellot website and mobile applications are who they claim to be and as such you are agreeing to release Excellot from user to consequence uprising that might be because of such disputes. Excellot will not in any way held liable for such disputes.
All users of Excellot website and mobile applications must be at least 13 years of age or older to use and access Excellot website and mobile applications in any format and if under the age of 18 or the age of defined as an adult age in your jurisdiction, the user must use any Excellot website and mobile applications under the supervision of a parent, legal guardian, or other responsible adult. It is your responsibility as a user of Excellot website and mobile applications to ensure that your use of the Excellot website and mobile applications follows and are in line with Excellot Terms and Conditions and all applicable laws in your jurisdiction.
Excellotserves as interface between the job seekers and Employers as well as between the trainees and the trainers. Hence, Excellot has no obligation to screen data exchanged, communicationsor any kind of information exchanged between the job seekers and Employers as well as between the trainees and the trainers in advance.
It is the responsibility of the Employers and Trainers to ensure that all materials provided in connection with services provided on Excellot website and mobile applications are not in violation of any laws, regulations or third-party propriety rights (including but not limited to trademarks, copyrights, public and privacy laws, zero tolerance to obscure and abusive among others). Hence, Employers and Trainers hereby grant Excellot rights toan all-inclusive, global and royalty-free license to use the Materials (provided on Excellot website and mobile applications) and hyperlink to Employer’s and Trainers website in connection with the Services.
Excellot reserves the right to update the terms and conditions on a regular basis and changes made will be binding the users of Excellot website and mobile application. The new Terms and Conditions posted are binding on the date posted and any use Excellot website and mobile application must conform to the last Terms and Conditions posted.
Should situations arise whether the above terms and conditions does not apply to a user due to country or state laws and regulations, Excellot maximum liability will not exceed $150 for such cases.
This subscription agreement is between your organization (“Customer or Employers or Trainer”) and Excellot LLC. This subscription agreement is subject to the terms and conditions displayed on this website and is applicable to the products and services provided by Excellot to its Customer/Employer and vice versa.
For the Job Portal, Excellot offer several subscription packages that Customers/Employers can choose from including budget plan, flat rate plan and free posting (for a limited amount of time and requires for approval from the Excellot Administrator. Employer have option to choose from any of the three available subscription plans and every posting can have its own unique plan. The Budget and Flat rate plans are paid subscription plans. The Budget plan offers an Employer the flexibility to change their posting and rate based on the needs of the organization. The Flat rate plan offer an Employer the opportunity to choose rate plan and posting are online for a specified period (usually 30 days), Employers are tied to the plan for specified time of the flat rate plan and can post job during this period. Note that there is no refund in the flat rate option and the posting will run for the specified period except termination or stopped by the Employer.
Free job posting is for specified period which are not renewable and terminate as soon as the free job posting period ends.
The subscription agreement commences on the date and time that the Employer pays the subscription and job posting goes live on Excellot website and mobile application. It shall continue for terms of the Subscription Package (under the Initial Term) unless terminated early by Excellot or the Customer/Employer) in accordance with the provisions of this Agreement. For the Flat rate plan, Employer’s subscription will not be automatically renewed, but subscription can be manually renewed by the Employer.
For the Training courses, all training courses purchase are final and there is no refund to the customer except a legitimate reason (acceptable to Excellot) is provided by the customer on why refund should be provided. Excellot reserves the right to determine what is a legitimate reason and what is not a legitimate reason.
Payments of subscriptions are completed using approved and standard payment gateways. Excellot does not store any of the Employer or user’s payment information, they are stored directly by the payment gateway company (currently “Paypal”).
Employers may cancel the subscription after the initial agreement period for the budget plan and flat rate periods except the Employers decides to renew the plan for an extended period. Employer can cancel by choosing not to renew the posting or decide not to include fund in the Budget plan option. Employers agrees and acknowledges that the subscription agreement cannot be cancelled during the Initial term period or a Renewal period other than violation of Excellot terms and conditions. It is important to note that Employers will not receive any refund upon cancelling the subscription, but that the job posting will be available on Excellot website and mobile application until the expiration of the initial subscription period or renewal subscription period.
